General Terms and Conditions for the SWIM for Kids GmbH Swimming School (hereinafter also referred to as “SWIM for Kids” or the “Swimming School”).

Scope of application

These General Terms and Conditions (GTC) apply to all contracts between the SWIM for Kids GmbH swimming school and customers, which are concluded via our website, by telephone, in person or via commissioned third parties.

Registration/ Conclusion of Contract

The presentation and advertising of services on our website does not constitute a binding offer to conclude a contract. Only by registering for a swimming course does the customer make a binding offer. We can accept this offer within seven days by sending a registration confirmation.
The registrations will be considered in the order of their receipt and the registrant will receive a confirmation of registration from the swimming school in electronic and/or written form.
Each participant must be registered individually and registrations are non-transferable.
A course unit is generally 45 minutes.
In coordination with the swimming school, a change of course can be made if the necessity for this arises. The prerequisite for this, however, is available capacity in the alternative courses, which cannot be guaranteed.

Services and prices

Our services and prices are stated in the current price list, which can be viewed on our website or obtained from us.
All prices are final prices and include the legal value added tax.
The offers are subject to change, all information is subject to change. Misprints and errors cannot be excluded.
The prices valid at the time of conclusion of the contract shall apply.

Terms of payment

The entire course fee is generally due before the start of the course and will be collected by direct debit.

Withdrawal and cancellation

Free course cancellations can be accepted up to 4 weeks before the course starts.
Cancellation must be made in writing to our company headquarters or by e-mail to kuendigung@swimforkids.de, stating the full name of the course participant and the course booked.
If a course is cancelled after this date, SWIM for Kids is entitled to retain 50% of the actual course fee.
If the cancellation of the registration is made up to 10 days before the start of the course, the full course fees will be due.
If the course cannot take place due to force majeure or has to be cancelled by the swimming school, the amount paid by the course participant will be refunded to the original account within 14 days after the scheduled start.

Liability and insurance

Insurance coverage by the swim school is limited to the scheduled time of the course and the course participant.
SWIM for Kids maintains a public liability insurance with a coverage of EUR 10,000,000.

The private stay within the swimming pool as well as the associated premises is at your own risk. There is no insurance coverage
The swimming school is not liable for accidents, injuries, illnesses or loss of objects, unless they are based on gross negligence or intent of the swimming school.
The swimming school is not liable for damages caused by the participant himself.
The swimming school is not liable for any damage to property caused by a course participant.
No liability is assumed for valuables and wardrobe.
The swimming school has no influence on the water temperature of the respective swimming pool. A guarantee and/or liability for a certain water temperature is not assumed.

Obligations of the course participants as well as the parents/guardians

Participants or parents (including legal guardians/representatives) are obligated to notify any physical limitations, illnesses or other relevant health aspects prior to the start of the course.
The customer must observe the house and bathing rules of the respective swimming pool.
The swimming pool may only be entered in the presence of the course management.
Only the course participants and the teaching staff are allowed to stay within the swimming pool during the course times. Parents (including legal guardians) do not participate in the course. The only exceptions are baby swimming courses offered by the swimming school, where one parent per child takes part in the course.
The instructions of the swimming pool staff as well as the employees of the swimming school are to be followed in principle.
Watching from outside is only possible in selected facilities.

Course completion/ Guarantee of success

1. we do not guarantee the successful completion of a course or the achievement of a specific swimming badge.

2. liability for non-achievement of the course goal is excluded.

Evaluations

1. the course participants and/or their parents (including legal guardians) receive a survey after completion of the course with the request to evaluate the respective course as well as the achievements. The evaluation takes place via points/ stars to be awarded and in the form of free text entries.

2. evaluations represent in principle the opinion of the author and not that of SWIM for Kids and/or the employees. Reviews must be written in accordance with the principle of fairness and must be based on verifiable facts. They must not contain any insulting, defamatory, criminally relevant or otherwise illegal content (e.g. violate the industrial property rights of third parties). Evaluations that violate this will not be published or deleted. 3.

By sending the rating, SWIM for Kids is granted a free, spatially and temporally unlimited right of use to the rating text. SWIM for Kids is entitled to freely dispose of the rating and, in particular, to process and use it for further rating services, to pass it on to third parties if necessary and to publish it.

4 Multiple evaluations, self-assessments or other forms of manipulation of the evaluation system are not permitted.

 

Data protection

1. SWIM for Kids collects, processes and uses personal data of customers in accordance with the provisions of the Data Protection Act and the privacy policy published and freely accessible on the website (“Privacy Policy”).

By registering, the customer agrees to the transfer of personal data to parties involved in the processing of the registration, the course implementation as well as the payment.

Final provisions

1. Should any provision of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that comes as close as possible to the economic purpose of the invalid provision.

2. the course participants and/or their parents (including legal guardians) agree that SWIM for Kids may be contacted by e-mail, telephone or post for up to 6 months after the cancellation in order to improve and expand its own offers. In addition, SWIM for Kids will inform about additions, extensions, news and cooperation offers.

SWIM for Kids reserves the right to change these General Terms and Conditions (GTC) at any time. The amended terms and conditions will be sent to the course participants and/or their parents (including legal guardians/representatives) by e-mail no later than four weeks before they come into effect, together with a notice stating that there is a possibility of objection. If the validity of the new GTC is not objected to within four weeks after receipt of the e-mail, the changes are deemed to be agreed. 4.

4 These GTC are subject to German law. The place of jurisdiction is the registered office of the swimming school.
